Introduction Welcome to the world of same-sex marriages, where two people of the same gender can legally tie the knot. The journey of same-sex marriages has been a long and bumpy one, with many countries legalizing it only recently. But did you know that same-sex marriages have been documented since ancient times? Yes, you heard that right. Unfortunately, same-sex marriages suffered discrimination and were illegal for several centuries. However, the love and hopes of the LGBTQ+ community could not be silenced, and they fought hard to legalize same-sex marriages through legislation. Today, we live in a world where the law acknowledges the right of same-sex couples to legally marry. But is the battle won? No, not even close. Discrimination and persecution still exist for the LGBTQ+ community, and same-sex couples face challenges even after marriage. Join us as we take you on a legal journey through the struggles, successes, and future of same-sex marriages globally and in India.

Indian Perspective

Indian Perspective:

India witnessed a major breakthrough in the LGBTQ+ rights movement with the Navtej Singh Johar verdict in 2018, where the Supreme Court decriminalized homosexuality by striking down Section 377 of the Indian Penal Code. The ruling was seen as a victory for the LGBT community, which for years had lived with the fear of persecution under the archaic law. However, the community still faces discrimination and marginalization, with social stigma and stereotyping being the biggest challenges. Discrimination extends to issues like employment, education, housing and healthcare. The lack of legal recognition for same-sex unions in India is another major concern for the community. Efforts towards decriminalization of homosexuality in India can be traced back to the early 90s, with activists fighting for equal rights for the community. The fight intensified in the late 2000s, with more and more people joining in the movement. The judgement in Navtej Singh Johar case marked a major milestone in this journey. Though the situation has improved, there's still a long way to go for the LGBTQ+ community to achieve true equality and freedom from discrimination.

 Global Perspective

Global Perspective:
When it comes to same-sex marriage, the legal landscape varies greatly around the world. In North and South America, same-sex marriage has been legalized in several countries, including Canada, the United States, Argentina, Brazil, and Mexico. In Europe, same-sex marriage has been legalized in much of Western Europe, as well as in Iceland and parts of Eastern Europe. However, there are still places around the world where same-sex marriage remains illegal, such as in Asia and Africa. International organizations such as the United Nations and the European Union have made it a priority to support LGBTQ+ rights and combat discrimination based on sexual orientation and gender identity. These organizations work to increase awareness and understanding of these issues, as well as to promote policies that protect the rights of LGBTQ+ individuals. Despite progress being made, there is still much work to be done to ensure that LGBTQ+ individuals can fully enjoy their human rights around the world. Legalization of same-sex marriage is just one step in the right direction. It is important to continue pushing for greater legal protections, as well as greater awareness and understanding of LGBTQ+ issues more broadly. The struggle for equality is ongoing, but with persistence and dedication, we can move closer to a world where everyone is treated with dignity and respect, regardless of their sexual orientation or gender identity.

Religious and Cultural Implications
When it comes to religion, it's not hard to guess what traditional views of marriage are. Across several religions, including Christianity, Islam, and Hinduism, marriage is seen as a union between a man and a woman. The texts and teachings are very clear on this point. However, as society evolves, so do the interpretations of these religious texts. The impact of these religious views on same-sex marriage legislation has been significant. Conservative religious groups have managed to lobby their way into shaping laws that dictate the lives of citizens who do not necessarily belong to that faith. The influence of religious bodies in shaping state policies is a point of contention, one that's been hard to ignore. Of course, there are liberal religious groups who extend their support towards LGBTQ+ rights too. Culturally, same-sex marriage is not accepted in many communities. The concept is relatively new and may take time to be fully embraced. Societal implications are therefore a significant challenge that same-sex couples face when it comes to acceptance. Often, same-sex couples have to deal with social stigma, discrimination, and harassment. However, initiatives for the LGBTQ+ community have also gained momentum. Across several countries, pride marches, events, and initiatives have been launched to spread awareness and create acceptance. The legalization of same-sex marriage is seen as a step towards a more inclusive and progressive world.

Legal Challenges Faced by Same-Sex Couples

Same-sex couples face numerous legal challenges around the world. Adoption and parenting rights are limited in many countries, with some not recognizing same-sex couples as eligible to adopt. This affects not only the couple's ability to have children but also the legal rights of the child. Inheritance and property rights are also problematic and differ from country to country. Without the legal recognition of their marriage, same-sex partners may not have the same rights as heterosexual partners, leading to difficulties in accessing inheritance and jointly owned property. Discrimination in the workplace and society is an unfortunate reality for many LGBTQ+ individuals. This can lead to difficult situations, such as being denied employment or being harassed at work. Same-sex marriage legislation can help mitigate these issues, but progress is still needed. Transgender marriage also poses unique legal complications. In some countries, transgender individuals are not able to change the gender on their legal documents without undergoing gender reassignment surgery. This can create difficulties for transgender individuals who wish to marry someone of the same sex. Overall, legal challenges faced by same-sex couples are complex and varied. Continuing to push for legal recognition of same-sex marriage can help alleviate many of these issues and improve the lives of LGBTQ+ individuals.

Future of Same-Sex Marriages in India and Globally

As far as the future of same-sex marriages in India and globally is concerned, there are a lot of challenges and opportunities that lie ahead for the LGBTQ+ community. While the Navtej Singh Johar verdict gave some hope, there is still a long way to go in terms of legal acceptance and societal recognition. One of the major challenges faced by the LGBTQ+ community is discrimination in the workplace and society. Even if same-sex marriages are legalized, there is still a lot of stigma and prejudice that needs to be addressed. However, with the right measures and laws in place, this could be overcome. Possible reforms and amendments to existing laws will play a crucial role in shaping the future of same-sex marriages. While some countries have already legalized same-sex marriages, others need to follow suit. Legislative changes that protect LGBTQ+ rights and promote equality will be key in achieving this goal. Finally, the role of public opinion and activism cannot be understated. It is the collective voice of the people that will ultimately drive change and legal reforms. So, whether it's signing petitions, attending rallies, or simply being supportive of the LGBTQ+ community, every voice counts. As we move forward, it's crucial that we acknowledge the struggles and challenges faced by the LGBTQ+ community and work towards creating a more accepting and inclusive society.

Conclusion
In summary, same-sex marriage has become legalized in many parts of the world, yet it still faces resistance due to cultural and religious beliefs. In India, homosexuality was decriminalized only recently, but societal and legal challenges persist. Same-sex couples continue to be at a disadvantage in areas such as adoption and inheritance rights. Looking forward, there is hope for reform and change as public opinion shifts towards acceptance and inclusivity. It is important for individuals to support the LGBTQ+ community through activism and education. In conclusion, the legal journey of same-sex marriage is complex and ongoing. It is crucial for society to continue to advocate for the rights of the LGBTQ+ community and work towards a future where all individuals have the freedom to love and marry whomever they choose.

Also the legalization of same-sex marriage in India has broken stereotypes and had a positive impact on the LGBTQ+ community. However, challenges still exist when it comes to adoption and raising children. Same-sex marriages also have cultural and economic implications. While different religions have varying attitudes towards same-sex marriage, education can play a crucial role in promoting acceptance.

Advocates are not above the Law : Madras High Court

A single bench of Justice M Dhandapani made these significant observations while considering the anticipatory bail application of a lawyer, who was accused of publicly intimidating police officials who had stopped her vehicle for travelling in violation of lockdown. The visuals of the lawyer threatening the cops had got public in media. The Court observed that advocates are also common citizens and they are not above the law. " An advocate is also a citizen, as common as all the other persons . Only because of his avocation and his social minded acts, the advocates rise up the pedestal and in fact that is the reason the law has given them the stature to question even the police. But that stature should be used in a legal and lawful manner without maligning the reputation and position of any individual person or any official of the Government. It is further to be stressed that  advocates are not above law  and, in fact, it is the advocates who have to gi...
